<p><font face="Arial" size="2">Your Majesty King Gyanendra</font></p>

<p><font face="Arial" size="2">On behalf of the Asian Women Workers Movement and Labour Movement, we wish to express our grave concern about the serious violation of women's rights, human rights, and labour rights in your country as a result of the declaration of state of emergency on February 1, 2005. We condemn your unconstitutional seizure of executive power, as this denies all forms of freedom and fundamental rights for the people of Nepal and is against all principles of democracy. 

<br><br>It has been brought to our attention, that a communication made by Ministry of Labour and Transport Management (MOLT) (dated Sept 16, 2005) to all recognised 3 trade union centres in Nepal, proposes an amendment to the Labour Act. The letter, in a threatening language calls for written comments within seven days for an amendment by the Royal Regime. Further, we understand that in case of no-comments, the ordinance will be put forward as accepted by concerned parties.

<p>We believe that recognised trade union centres and employers organisations are social partners on an equal footing with the the government. Therefore we, on behalf of the Asian Women Workers Movement and Labour Movement, would like to remind the government about the equal status of the social partners and we support GEFONT, NTUC and DECONT in their opposition to such autocratic processes. We feel this is the murder of democracy adopting a different and seemingly non-violent strategy. The proposed draft ordinance without consultation with employers and workers organisations has created more serious doubts on the intention of the regime.

<p>We understand that Nepal is in a state of extreme political crisis. Many industries are being closed down and the economy is in trouble. As far as we believe, the issue of labour law reform is an issue of bipartite consensus between workers and employers, and not a conspiratory game to please invisible forces &amp; to fulfil the vested interest of the regime. Therefore we would like to make it clear that we cannot accept such ordinance which ignores existing tripartite Central Labour Advisory Committee at a time when peoples' representative institution 

e.g. parliament is not functioning.</p></font>

<p><font face="Arial" size="2">We, the conscious international community wish to reaffirm that your actions are unacceptable and clearly a violation of all internationally recognised trade union, women and human rights. This is yet another example of how your actions have created more conflict and suffering for the common people in Nepal. This is also a prime example of your autocratic rule which makes a mockery of the rule of law, the supremacy of the parliament and the constitution of the nation. Therefore, restoring all democratic and trade union rights is indispensable to put the country back on the path to full democracy.

<p><font face="Arial" size="2">We strongly urge you:</font></p>

<ol>

<li><font face="Arial" size="2">Make any amendments to the labour law only with full agreement and discussion with representatives of recognised trade union centres and employers' organisations like GEFONT, NTUC and DECONT.

<li><font face="Arial" size="2">Repeal the unconstitutional Royal proclamation </font>

<li><font face="Arial" size="2">The King should return to the constitutional monarch</font> 

<li><font face="Arial" size="2">Restore the multi party system and democracy</font> 

<li><font face="Arial" size="2">To release unconditionally all the trade union, women, students, human rights , media ,political activists and all other politically detainees</font> 

<li><font face="Arial" size="2">Stop harassing all the the trade union, women, students, human rights , media , lawyers,political activists and all those have different views.</font> 

<li><font face="Arial" size="2">Lift all measures that deny fundamental human rights, democracy, press/media freedom, women and trade union rights</font></li></li></li></li></li></li></li></ol><font face="Arial" size="2">


<p>We will continue to monitor the situation in Nepal and protest until full democracy, human rights, women's rights and labor rights are restored in Nepal. </p></font>
