Mass dismissal at Toyota Philippines
Tokyo District Court,
Dismissed Japanese Union’s Claim
On Monday, August 6, the Tokyo District Court rendered a judgment on a lawsuit
brought by a Japanese union seeking the cancellation of the order previously
issued by the Central Labor Commission refusing a relief petitioned by that
union, in support of the local union, on the ground that there had been an
unfair labor practice over the mass dismissal of employees by a local company in
the Philippines of Toyota.
Chief Judge Hiroshi Watanabe held that “the allegation of the Plaintiff is
intended to seek relief regarding a labor dispute between the local company and
workers, and therefore cannot enjoy the application of the Labor Union Law of
Japan.”
Plaintiff was All-Japan shipbuilding & Engineering Workers Union, Kanagawa
District Union.
In 2001, some 230 local workers in conflict of opinions with the company over
the organization of a union were dismissed, and regarding this fact, Plaintiff
had filed a petition for relief on the ground that it constituted a unfair labor
practice that Toyota Headquarters having control over the local company refused
a collective bargaining negotiation with Kanagawa District Union as the
Plaintiff in this lawsuit, but the Kanagawa Labor Commission had ruled out the
petition in August 2006.
The Central Labor Commission had also ruled out the appeal for reexamination in
December last year.
